Welcome to Kreshendo Kreations and Kreshendo Kast (“Kreshendo,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of:

Our websites, including but not limited to kreshendokreations.com, shop.kreshendokreations.com, and any related subdomains;
The Kreshendo Kast platform and related tools;
Our hosting services, digital products, content, and any other services we provide (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You may also be subject to additional terms (for example, product-specific terms, affiliate terms, or third-party tool terms). Where there is a conflict, those additional terms will generally control for that specific product or feature.

1. Eligibility & Accounts

To use our Services, you must:

Be at least 18 years old (or the age of majority in your jurisdiction); and
Have the legal capacity to enter into a binding agreement.

When you create an account or sign up for hosting, Kreshendo Kast, or our shop, you agree to:

Provide accurate, current, and complete information;
Keep your login details secure and confidential;
Be fully responsible for all activity that occurs under your account.

If we believe you’ve provided inaccurate information, shared your account inappropriately, or used the Services in violation of these Terms, we may suspend or terminate your account.

2. Our Role: Platform, Tools & Content

Kreshendo provides:

A creator-focused platform (Kreshendo Kast) and related tools to help you build Direct-to-Fan (D2F) systems;
Web hosting and simple sites (including free or limited plans, where offered);
Digital products and resources (eBooks, toolkits, templates, etc.);
Educational content, blog posts, and other materials.

We do not act as your employer, manager, label, agent, lawyer, or financial advisor. You are responsible for your own business decisions, compliance with laws, and results.

We may update, improve, or modify the Services at any time, with or without notice.

3. User Content & Your Responsibilities

“User Content” means any content you upload, submit, or otherwise make available through the Services, including but not limited to:

Music, beats, stems, audio files;
Videos, images, artwork, and graphics;
Text, copy, descriptions, profiles, metadata;
Products you list or sell through any store or marketplace features.

By using the Services, you agree that:

You own or have the rights to all User Content you upload or distribute, and you are not infringing anyone’s intellectual property, privacy, or publicity rights.
You are responsible for all User Content and activity via your account, even if managed by team members.
You will not upload or share content that is:
- Illegal, fraudulent, defamatory, or misleading;
- Hateful, harassing, or discriminatory;
- Pornographic, sexually explicit, or exploitative;
- Intended to promote violence, self-harm, or illegal activity;
- Malware, spam, or any harmful code.

We reserve the right, but not the obligation, to review, remove, or restrict access to User Content that we believe violates these Terms or applicable law.

4. License to Us (For Operating the Services)

To operate and improve the Services, you grant Kreshendo a limited, non-exclusive, worldwide, royalty-free license to:

Host, store, reproduce, display, and distribute your User Content via the Services;
Use your User Content in connection with providing you with features like streaming, preview, download, backups, and similar functions.

We do not claim ownership of your User Content. You can generally remove your content at any time, but some copies may remain in backups, logs, or as part of analytics for a reasonable period.

5. Hosting & “Free for Life” Plans

We may offer free or limited hosting plans as an entry point into our ecosystem. These offers may be subject to specific limits and conditions, such as:

Storage, bandwidth, or traffic limits;
Limited features or resources;
Requirement to comply with branding, link, or attribution guidelines;
Fair-use policies and restrictions on abuse or misuse.

We reserve the right to:

Modify or discontinue any free plan at any time;
Offer upgrade paths to paid plans for more advanced or resource-intensive use;
Suspend or terminate hosting for abuse, illegal content, or violation of these Terms.

Free hosting is provided “as is” and without any guarantee of uptime, performance, or future availability. We recommend that you always maintain your own backups.

6. Storefronts, Sales & Third-Party Payments

If you use our Services to sell beats, music, digital products, or physical goods (now or in the future):

You are responsible for:
- Setting prices and product details;
- Fulfilling any physical orders;
- Delivering digital products;
- Handling your taxes (e.g., VAT, sales tax, income tax);
- Complying with consumer protection and e-commerce laws in your region.

Payments may be processed by Stripe, PayPal, or other third-party processors. Those services are provided under their own separate terms and privacy policies. We are not responsible for their actions, downtime, or errors.

You understand that:

Fee structures, commissions, and payout timelines may vary depending on payment processors and any marketplace features we offer;
We may charge platform fees, transaction fees, or commissions when you use our marketplace or monetization features (these will be disclosed separately in the product or module terms).

We do not guarantee any particular level of sales, income, or results.

7. Affiliates, Partner Tools & External Links

Our Services may include:

Links to third-party tools (e.g., SaaS platforms, AI tools, schedulers, email platforms);
A Creator Tool Stack or integrations area;
Content containing affiliate links.

Some of these links are affiliate links, which means that:

If you sign up or purchase through those links, we may earn a commission at no extra cost to you;
Those products and services are operated by third parties, not by Kreshendo.

We do not control and are not responsible for:

The content, policies, or practices of any third-party sites or tools;
Changes those companies make to their pricing, features, or availability.

You should review the terms and privacy policies of any third-party products or services before using them.

8. Intellectual Property

The Services, including but not limited to:

The Kreshendo Kreations and Kreshendo Kast names, logos, and branding;
Our website design, layouts, and visual elements;
Our original content, educational materials, and digital products (unless otherwise noted),

are protected by copyright, trademark, and other intellectual property laws.

You agree not to:

Copy, reproduce, or redistribute significant portions of our content, designs, or code without permission;
Use our trademarks or branding in a way that suggests endorsement without our written consent.

You retain ownership of your User Content, subject to the limited license you grant us under these Terms.

9. Prohibited Uses

You agree not to use the Services to:

Engage in any unlawful activity or violate any applicable law;

We share strategies, systems, and tools for creators, but:

We do not guarantee specific results (e.g., sales, streaming numbers, follower growth, or income);
Your outcomes depend on your own efforts, implementation, market conditions, and external factors beyond our control.

Any examples, case studies, or testimonials provided are illustrative only and do not guarantee that you will achieve the same results.

11. Payment, Refunds & Cancellations

Where we charge for services, subscriptions, or digital products:

Prices and payment terms will be displayed at checkout or in product-specific pages;
Taxes may be added where required by law;
Subscriptions may renew automatically unless you cancel in accordance with the product’s terms.

Because many of our products are digital and delivered instantly, refunds may be limited or not available, except where required by law or specified in a product-specific refund policy.

You are responsible for cancelling any recurring subscriptions before the next billing cycle if you no longer wish to be charged.

12. Termination

We may suspend or terminate your access to the Services, in whole or in part, if:

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance;
Any guarantee that the Services will be uninterrupted, secure, error-free, or compatible with your devices, software, or configuration.

We are not responsible for:

Loss of data, revenue, or profits;
Any actions or content of third parties (including other users and external tools);
Any changes in third-party services that affect how you use Kreshendo.

You use the Services at your own risk.

14. Limitation of Liability

To the fullest extent permitted by law:

Kreshendo, its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services (including loss of profits, data, or goodwill), even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Services will not exceed:

The amount you paid to us for the Services during the three (3) months immediately prior to the event giving rise to the claim; or
If you have not paid anything, one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations; in such cases, these limitations will apply to the maximum extent permitted by law.

15. Changes to These Terms

We may update or modify these Terms at any time. When we do, we will:

Update the “Last updated” date at the top; and
In some cases, provide additional notice (e.g., via email or a notice within the Services).

By continuing to use the Services after the updated Terms become effective, you agree to be bound by the revised Terms.

If you do not agree with the changes, you must stop using the Services.

16. Governing Law & Disputes
